TERMS AND CONDITIONS OF USE

PREAMBLE
The Seller (as defined in Article 1) operates an e-commerce business offering the sale of Products (as defined in Article 1) through the website www.saraenparis.com (hereinafter referred to as “the Website”). These terms and conditions of sale (hereinafter “Terms and Conditions”) apply exclusively to Buyers (as defined in Article 1).

ARTICLE 1 – DEFINITIONS

“Buyer”: An individual, non-professional, purchasing Products through the Website.

“Seller”: SARAÉN, a sole proprietorship registered with the Paris Trade Registry under number 901 959 544 00023, with its registered office located at 3 Avenue Raspail, 95330 Domont, France. The Seller can be contacted at contact@saraenparis.com. Siret number: 901 959 544 00023.

“Product”: All products available for purchase by Buyers on the Website.

“Parties”: Collectively refers to the Seller and the Buyer.

ARTICLE 2 – OBJECT
These Terms and Conditions define the rights and obligations of the Seller and the Buyer in connection with the sale of Products via the Website.

ARTICLE 3 – SCOPE
The Terms and Conditions apply to all sales of Products made by the Seller to the Buyer via the Website. The Seller reserves the right to modify the Terms and Conditions at any time. The Terms and Conditions applicable to each order are those in effect on the date the order is placed. The validation of an order implies the Buyer's acceptance of these Terms and Conditions, confirmed by checking the relevant box during checkout.

ARTICLE 4 – ORDER
The Buyer places orders through the Website. All contractual information is provided in French and English (for informational purposes only) and is confirmed to the Buyer at the latest upon delivery.

4.1 ORDER VALIDATION
The Buyer acknowledges having read the Terms and Conditions prior to validating the order and understands that this validation implies prior acceptance. The Buyer agrees that the Terms and Conditions will remain available for retention and reproduction in accordance with Article 1369-4 of the French Civil Code.

The Buyer must provide their information and complete an online form available on the Website. Corrections are possible until final validation. The Seller will send an email confirming receipt of the order and its details.

4.2 OFFER VALIDITY – PRODUCT UNAVAILABILITY
Products displayed on the Website are available as long as they are listed, subject to stock availability. Product images and descriptions are illustrative and may be modified without affecting the Seller's liability or the validity of the sale.

If a Product is unavailable, the Seller will notify the Buyer by email and offer an exchange or refund within 30 days of the order's validation. If a Product is out of stock, the Seller may ship the available items and refund the unavailable item.

ARTICLE 5 – PRICE – PAYMENT
The prices displayed on the Website include taxes but exclude shipping costs. The Seller reserves the right to change prices; however, the price in effect at the time of order validation will apply.

5.1 PAYMENT METHOD
Orders are paid for by credit card through a secure server at the time of ordering. The Buyer's payment information does not transit through the Website. Credit card payment is irrevocable, except in cases provided for in Article 7.

5.2 TRANSFER OF OWNERSHIP
Ownership of the Product transfers to the Buyer once the Seller receives full payment. However, risk related to the Products transfers to the Buyer upon order confirmation.

5.3 PAYMENT DEFAULT
The Seller may refuse delivery or fulfillment if the Buyer has not fully accepted the Terms and Conditions or if there are outstanding payment issues from previous orders.

ARTICLE 6 – DELIVERY
Deliveries are made via [name of chosen carrier, e.g., La Poste]. Delivery fees are calculated based on the weight and destination and are included in the total order price.

The Seller processes orders within thirty days of order validation. In the event of a delay, the Buyer may cancel the order by contacting the Seller at contact@saraenparis.com. The refund will be issued within 15 days after the returned package is received, if necessary.

ARTICLE 7 – CANCELLATION – RETURN – REFUND

7.1 GENERAL RETURN TERMS
All returns must be notified to contact@saraenparis.com. If a package is lost, the Buyer bears responsibility unless the return is tracked.

7.2 RIGHT OF WITHDRAWAL
The Buyer has 14 days from receipt of the Product to return it for a refund, with return postage paid by the Buyer. Products must be returned in their original condition, complete with all accessories.

7.3 REFERENCE ERRORS
The Buyer must notify the Seller within 15 days of receiving the wrong Product to obtain return authorization.

ARTICLE 8 – WARRANTY
The Buyer is entitled to the "hidden defects warranty" in accordance with Article 1641 of the French Civil Code.

ARTICLE 9 – LIABILITY
The Seller's liability is limited to foreseeable damages resulting from the Buyer's use of the Website and Products. The Seller is not liable for damages caused by the Buyer, the carrier, third parties, or in cases of force majeure.

ARTICLE 10 – INTELLECTUAL PROPERTY
The Website content is protected under the French Intellectual Property Code and may not be reproduced without the Seller's authorization.

ARTICLE 11 – PERSONAL DATA
The Buyer's personal data is collected and processed in accordance with French law for order management and service customization.

ARTICLE 12 – EVIDENCE
Electronic communications are accepted as evidence, provided security measures are in place.

ARTICLE 13 – PARTIAL INVALIDITY
If any provision of these Terms and Conditions is deemed invalid, the remaining provisions remain in effect.

ARTICLE 14 – APPLICABLE LAW
These Terms and Conditions are governed by French law.

ARTICLE 15 – JURISDICTION
Disputes unresolved within 45 days of notification may be referred to the competent court.
